Changes in Rockefeller Drug Laws

New York State Drug Crimes Defense

If you have been convicted of a drug crime in New York, your status may be affected by recent changes to the Rockefeller Drug Laws. Certain drug offenders are now eligible for alternatives to incarceration, shock incarceration, reduced sentencing, treatment programs, early dismissal from prison and other options.

Jonathan R. Sennett, P.C. helps clients navigate the recent sweeping reform of the Rockefeller Drug Laws. To find out if you are eligible for any of these options, please call our Kingston office at 845-943-2261 or 866-585-1091 toll-free, or contact us online.

Changes in Rockefeller Drug Laws

For years, New York law required mandatory minimum sentencing for all drug offenders. Through the recent changes to the Rockefeller Drug Laws, lawmakers have now taken away many of these mandatory minimum sentences for those who have been convicted of low-level drug felonies. These changes reflect a concerted effort to focus more on drug treatment rather than punishment.

Through these changes in the law, the Department of Corrections has been given an expanded ability to release drug offenders early. They may make recommendations for enrollment in drug treatment programs as an alternative to incarceration.

Explore Your Options

Due to the changes in Rockefeller Drug Laws, there are a wider variety of potential dispositions, pleas and sentencing options for drug offenders. However, these options are not necessarily available to all offenders. It is therefore extremely important that drug offenders understand what options are available to them.

Your options will vary depending upon the level of offense committed. Felony drug crimes in New York are divided among various categories, each of which have extensive subcategories. In order to clarify these complex laws and fully understand your options, it is best to contact a lawyer for more information.

If you have been charged with a drug crime for the first time or if you have already been convicted, attorney Jonathan R. Sennett can help determine your eligibility for the newly enacted sentencing alternatives under the Rockefeller Drug Laws. Even though you may be required to go to prison, you may have more options than before.
